Terms of service

SIA Meduskalni, Registration No. 43603052372, legal address: Ģedules iela 6, Iecava, LV-3913, Latvia (hereinafter – the “Seller”), operates the Moonell online store (hereinafter – the “Online Store”) and offers goods in accordance with these Terms of Service.

1. General Provisions

If a consumer purchases goods or services through this website, such mutual agreement shall be considered a distance contract and is subject to the legal provisions of the Republic of Latvia regulating distance contracts, including but not limited to the Consumer Rights Protection Law and Cabinet of Ministers Regulation “Regulations Regarding Distance Contracts”, and other applicable laws.

2. Placing Orders

The prices and specifications of products sold in the Online Store are indicated next to the relevant products. All prices are shown in euros (EUR). Delivery costs are added where applicable and are displayed before the Buyer confirms the order.

To place an order, add the desired products to your shopping cart. Fill in all required fields and select the preferred delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Complete the payment to finalize the order.

3. Payment Terms

The currency used on the website is EUR.

Payments can be made using the following methods provided by the payment platform makecommerce.lv, operated by Maksekeskus AS:

  • Latvian online banking: Swedbank, SEB, Citadele, Luminor
  • Estonian online banking: Swedbank, SEB, Luminor
  • Lithuanian online banking: Swedbank, SEB, Luminor
  • Finnish online banking: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki
  • Visa / Mastercard payments

Note: When using online banking, confirm the order and click the button “Return to merchant”.

Personal data required for payment processing is transferred to the licensed payment institution Maksekeskus AS.

The contract enters into force upon successful payment to the Online Store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be informed as soon as possible and all amounts paid for the order, including applicable delivery costs, will be refunded without undue delay and no later than 14 days after notification.

4. Delivery Terms

Goods are currently delivered to Latvia, Estonia, Lithuania, selected European countries, the United Kingdom, the United States, Canada and Australia.

Available delivery methods depend on the destination and may include courier delivery and parcel shops through delivery partners such as DPD, Omniva, Latvijas Pasts and Venipak. The delivery methods available for each destination are displayed at checkout.

Available delivery methods, delivery costs and any applicable free-delivery threshold are displayed at checkout before the Buyer confirms the order.

Estimated delivery times after dispatch are:

Latvia: 1–2 business days
Estonia and Lithuania: 1–2 business days
Selected European countries: 3–5 business days
United Kingdom: 3–5 business days
United States, Canada and Australia: 5–8 business days

Order preparation time may vary depending on the product. Where a product is made to order, the applicable production or preparation time is indicated on the product page or communicated to the Buyer before dispatch.

Delivery times are estimates and may vary depending on the destination, carrier and circumstances beyond the Seller's reasonable control.

For deliveries outside the European Union, import duties, taxes, customs clearance charges or other fees may apply depending on the destination. Where such charges are not collected at checkout, they are the responsibility of the Buyer.

If the Seller is unable to meet the stated delivery period, the Buyer will be informed as soon as possible. Where a longer delivery period is required, a new delivery timeframe will be agreed with the Buyer. Unless otherwise expressly agreed, goods will be delivered within the timeframe required by applicable law.

5. Right of Withdrawal

The Buyer has the right to withdraw from the purchase within 14 calendar days from the receipt of the goods.

The right of withdrawal does not apply to legal entities.

Items purchased at a discounted or promotional price cannot be returned.

During the withdrawal period, the consumer may inspect and try on the goods only to the extent necessary to establish their nature, characteristics, appearance and fit, in the same way as would reasonably be permitted in a physical store.

The consumer is responsible for any decrease in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning. Where such a decrease in value has occurred, the Seller may reduce the refund accordingly.

To exercise the right of withdrawal, You must contact info@moonell.eu within 14 days of receiving the goods.

The Buyer bears the cost of returning the goods unless the return is due to non-compliance with the order (e.g., incorrect or defective product).

The Buyer must return the goods without undue delay and no later than within 14 days after submitting the withdrawal form. The Seller will reimburse the Buyer without undue delay and no later than 14 days from the day on which the Seller is informed of the Buyer’s decision to withdraw. The Seller may withhold reimbursement until the returned goods have been received or until the Buyer provides evidence that the goods have been sent back, whichever occurs first.

The Seller may withhold the refund until the goods are received or proof of return is provided.

If the Buyer has chosen a delivery method that is more expensive than the least expensive standard delivery method offered by the Online Store, the Online Store is not required to refund the additional delivery costs.

The Online Store shall not be liable for delays or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

The Online Store reserves the right to cancel an order where the price displayed on the website is clearly and materially incorrect due to an obvious technical or human error. In such a case, the Buyer will be informed promptly and any amount already paid will be refunded.

6. Consumer Rights Regarding Non-Conforming Goods

The Online Store is responsible for any non-conformity that existed at the time of delivery and becomes apparent within two years from the date of delivery.

If the non-conformity becomes apparent within one year after delivery, it is presumed to have existed at the time of delivery unless the Online Store proves otherwise or such a presumption is incompatible with the nature of the goods or the type of non-conformity.

The Buyer must notify the Seller of the non-conformity within two months of discovering it by contacting info@moonell.eu.

The Online Store is not responsible for defects that arise after delivery.

If defects are attributable to the Seller, the Buyer has the right to request repair or replacement free of charge.

If repair or replacement is not possible, the Seller will refund all payments. A written response to a consumer’s complaint will be provided within 15 working days of receipt. If it is objectively impossible to respond within that period, the consumer will be informed in writing of the reason and provided with a reasonable timeframe for the response.

7. Processing of Buyer’s Personal Data

The Online Store processes the Buyer’s personal data in accordance with its Privacy Policy. Personal data necessary for order fulfilment may be shared with payment, delivery and other service providers involved in processing the order.

Where the Buyer has consented to receive marketing communications, they may unsubscribe at any time using the unsubscribe link in the communication or by contacting info@moonell.eu.

8. Dispute Resolution

For matters not covered in these Terms, the Buyer and Seller shall comply with the laws of the Republic of Latvia.

Any disputes between the Buyer and Seller shall first be resolved through negotiations or correspondence. If no agreement is reached, disputes shall be resolved in the courts of the Republic of Latvia in accordance with applicable laws.

If a dispute cannot be resolved directly with the Online Store, the consumer may seek assistance from the Consumer Rights Protection Centre of Latvia (PTAC) and, where applicable, submit the dispute to the Consumer Dispute Resolution Commission. The consumer also retains the right to bring the matter before a competent court.
